LANSING, Mich. -- Six restaurant owners and the Michigan Restaurant Association (MRA) today won a final battle against an attempt by the City of Marquette to ban smoking in restaurants.
By refusing to hear the City's appeal, the Michigan Supreme Court upheld two lower court decisions disallowing the ban. Both of those previous decisions -- by the Marquette Circuit Court and the Michigan Court of Appeals -- held that only state law, not local ordinances, can regulate smoking in Michigan restaurants.
