Jul. 3--The city of Rochester's appeal of a federal ruling permitting expansion of the Dakota, Minnesota & Eastern Railroad is being delayed, possibly until 2003.
The delay is the result of a motion filed June 26 by a co-petitioner, the Sierra Club, which alleges the federal Surface Transportation Board has failed to provide a full and complete record of the documents and testimony it used to come to its decision on the DM&E's $1.5 billion expansion.
