The New Jersey Supreme Court ruled unanimously that a municipality's condemnation of part of a landowners property to provide access to an adjoining parcel was for a public purpose and did not abuse the power of eminent domain (Township of West Orange v. 769 Associates, LLC, No. A-45-01, June 20, 2002).
769 Associates owns a parcel of land on Northfield Avenue in West Orange, improved with an office building and a parking lot that serves the building tenants.
