Federal agency loses in set-aside dispute
The federal government can no longer hand all of a particular contract to minority businesses and exclude non-minorities, according to a recent decision involving in Mississippi construction company.
The southern U.S. District Court ruled in April that the U.S. Army Corps of Engineers and the Small Business Administration (SBA) violated federal law when they set aside 100 percent of Corps projects available to small businesses in a district exclusively for "socially and economically disadvantaged" contractors. Under this provision, other firms were barred from participation of any kind.
