Robert Konop maintained a secure Web site for other employees of Hawaiian Airlines. He controlled access through a user name and password. He accused his employer of hacking into his Web site. The 9th Circuit Court of Appeals recently issued an opinion in Konop's case that addressed the application of the Federal Wiretap Act and the Stored Communications Act to such secure Web sites.
The Court concluded that hacking a secure Web site generally does not violate the Federal Wiretap Act. That act extends to the "interception" of electronic communications, but the court concluded that the word "intercept" is limited to acquisition of the communication that is ...
