CASE FACTS: Kathleen States underwent surgery for the removal of an ovarian cyst. The operation was uneventful except for a complaint of pain when an I.V. tube was inserted in the back of the patient's right hand prior to surgery. The patient awoke after surgery complaining of extreme pain in her right hand, arm, shoulder, and side. The patient and her husband, derivatively, brought suit for medical malpractice against, inter alia, Dr. Kenneth Mintz, an anesthesiologist, who attended her during the surgery as well as his professional group, Riverside Associates in Anesthesia, P.C.
