Dec. 5--RICHMOND, Va.--On Wednesday, federal appeals judges criticized a court ruling that blocked coal operators from burying Appalachian streams beneath huge piles of mining waste.
A three-judge panel of the 4th U.S. Circuit Court of Appeals said that the ruling was far too broad, and signaled that they planned to overturn the decision.
One of the appeals judges, J. Michael Luttig, referred to the "bizarre" and "unorthodox" nature of the decision by U.S. District Judge Charles H. Haden II of Southern West Virginia.
