The U.S. District Court for the District of Columbia has decided two cases importantly bearing upon FDA regulation of health claims for foods and dietary supplements, according to Food Institute counsel Olsson, Frank and Weeda, P.C. Each case is important for interpreting the propriety of a specific aspect of FDA's regulation of health claims under the Nutrition Labeling and Education Act of 1990, the Dietary Supplement Health and Education Act of 1994 and commercial speech protection emanating from the First Amendment, as construed in Central Hudson Gas & Elec. Corp. v. Public Serv. Comm'n of New York, 447 U.S. 557 (1980) and Pearson v. Shalala, 164 F.3d 650 (D.C. Cir. 1999). ...
