Stephen M. Cutler, the SEC's top cop, yesterday asked members of a House subcommittee for several changes in existing laws, including one change that would allow the commission to impose civil penalties in administrative proceedings against non-registered individuals and entities.
The request for additional authority on civil penalties could be significant for the municipal market because the Securities and Exchange Commission often brings administrative or "cease and desist" proceedings against issuers and other participants of municipal securities transactions that are not registered with it, sources said.
