A county judge has ruled that the lawsuit brought by former contract hog producers for Tyson Foods Inc. has standing and will be heard in the Pope County court in Russellville, Ark.
The suit was filed following a decision last year by Tyson Foods to discontinue its hog production business and, therefore, to terminate contracts with growers (Feedstuffs, Aug. 26, 2002). The company said the business, with growers in Arkansas and Oklahoma, required importation of feed grains from the Midwest and exportation of finished hogs to packers in the Midwest, and transportation costs in and out made Tyson Foods uncompetitive with midwestern producers.
