Apr. 10--The city of Las Cruces has filed motions in District Court seeking dismissal of a lawsuit filed by the Las Cruces Sun-News, or if heard, that it be conducted without a jury trial.
The motions were filed in late March by Matthew Holt, a Las Cruces lawyer who is representing the city. The Sun-News, with the New Mexico Foundation for Open Government, filed a lawsuit in New Mexico's 3rd Judicial Court in late February accusing the Las Cruces City Council of violations of the state's Open Meetings Act.
