While Elton Burks was once released on bond while facing a murder charge in local court, the Gary man with a lengthy criminal history will remain in custody on a federal gun offense, a judge ruled Wednesday. U.S. Magistrate Andrew Rodovich ordered that Burks stay in jail. Rodovich said he would put his reasoning for his ruling in writing later.

During Burks' probable cause and detention hearing at the federal court in Hammond the prosecuting and defense attorneys offered arguments on whether Burks should be released while the federal case is pending.
