11, 2009 I appreciate being given the opportunity to participate in this
hearing regarding Circuit City's pending chapter 11 case and the effect
the Bankruptcy Code (the ``Code`` or the ``Bankruptcy Code``) has had on
companies in the retail industry, such as Circuit City, that attempt to
reorganize. I commend the Subcommittee for focusing on how the provisions
