Constitutional Rights and the Grand Jury
I. Background
Few parts of the criminal justice system have been as routinely criticized,
or have withstood the criticism better, than the grand jury. Although
the
5th Amendment to the Constitution requires that all serious criminal
charges
be subjected to grand jury review, modern commentators are nearly
unanimous
in concluding that the institution does not protect suspects from
weak
or unfounded accusations. Rather than imposing a significant check
on the
government's charging decisions, the belief is that grand jurors invariably
approve any indictment ...
