Vic: Man jailed over alleged bashing wins new trial

MELBOURNE, Dec 2 AAP - A man jailed for 16 years for stomping on the head of a mentally ill prisoner in a cell beneath the Melbourne Magistrates Court has won a new trial because of an error made by the trial judge.

The Victorian Court of Appeal ruled that the judge in the case should have, as a matter of law, told the jury the defendant may have lied, but the lies did not necessarily point to guilt.

The man, 29-year-old Ali Ali, was sentenced to 16 years with a minimum of 13 years for intentionally causing serious injury to Michael Tully, then 44, on April 29, 1999.
