Under current immigration laws, U.S. Citizens and Green Card holders have
the ability to sponsor their spouses and children to legally remain in this
country. However, in marriages where the U.S. citizen or Green Card holder
is physically and/or emotionally abusive, he may refuse to help the foreign
spouse with her immigration paperwork or threaten to report the battered
spouse to INS if she leaves or tries to get help. Sometimes, the abused
person is a child whose abusive parent may use the same controlling
behavior and refuse to help the child with her immigration paperwork.
