Makers of an electronic belt that's advertised to trim waistlines cannot use the Energizer trademark, according to a settlement announced Wednesday.
Eveready Battery Co. Inc., a subsidiary of St. Louis-based Energizer Holdings, Inc., also won a $2 million judgment against California-based Abflex USA. Inc. Energizer's lawsuit alleged trademark dilution, unfair competition and business practices, and injury to business reputation.
Energizer said Abflex was using the AB Energizer trademark to sell an electronic muscle stimulation exercise belt through infomercials, in stores and on the Internet.
