A man could not obtain visitation with a child born during his
marriage but fathered by another man as the result of his ex-wife's
extramarital affair, the Colorado Court of Appeals has ruled in
reversing a visitation order.
The plaintiff's wife gave birth to a child when the couple resided
in Minnesota. Three years later, the plaintiff learned that he was
not the child's father as the result of a paternity action instituted
by the biological father. A Minnesota court granted custody of the
child to the mother and visitation to the plaintiff.
After the marriage ended, the child and her parents moved to
