Plaintiff can sue police chief for invasion of privacy, rules Iowa Court of Appeals

A man who claimed the local police chief repeatedly drove past his home and peered inside can sue for invasion of privacy, the Iowa Court of Appeals has ruled in reversing a summary judgment.

The plaintiff had been embroiled in ongoing political antagonism with the local police chief and mayor. He claimed that the chief spent several months slowly driving by his house and that peering into his home. The plaintiff alleged this surveillance was ongoing, including one occasion when the chief drove back and forth five or six times in as many minutes while staring up his driveway.
