Kanawha County commissioners approved Sheriff-elect Mike Rutherford's request to hire his brother, Johnny, as his chief deputy on Wednesday.

Police officers from around the county packed the Commission Courtroom to see Johnny Rutherford's approval and swearing-in.

But Commissioner Dave Hardy voted against the hiring, saying it's still a case of nepotism.

"On its face, when you hire your brother, it's not a good practice," he said. "This is no reflection on Mike or John, but you're just setting yourself up for criticism. This does meet the definition for nepotism as defined by Webster's Dictionary. It's hair- splitting to say otherwise."
