RECENTLY, the United States House of Representatives passed the
Local Law Enforcement Hate Crimes Prevention Act of 2007, or H.R.
1592. The effect of this legislation would be to add gender and
sexual orientation to the categories covered by federal hate crimes
laws. Such laws provide enhanced penalties for crimes motivated by
bias against an identifiable social group.
Currently, the federal law gives prosecutors discretion to charge
a hate crime if the criminal act was prompted by the victim's
religion, race, color or national origin. Based on statistics
provided by the FBI, 237 members of the House of Representatives
