Article: Employee can recover damages for retaliation, rules 11th Circuit

A Title VII plaintiff could recover damages for retaliation where he was fired from his job after refusing to sign an arbitration agreement that would have covered his pending race discrimination claim, the 11th Circuit has ruled in affirming a $554,000 jury award.

The plaintiff, an African-American, worked making elevator parts at the defendant's plant. He filed a Title VII complaint with the EEOC, alleging that he was denied a promotion because of his race and that he endured a hostile work environment because of the commonplace use of racial slurs by his superiors.
