A civil suit filed against a West Side tavern by the widow of a
man killed by a drunken driver has been settled.
Robert Simpkins, an attorney representing Kelly Mudd and her two
children, confirmed this week that a trial in the case against
Sportsman's Grill & Billiards originally scheduled for next month
will not take place.
He said the lawsuit was settled after mediation, and the terms of
the settlement will be sealed.
The civil suit was filed under the theory of dram shop liability,
in which liquor establishments can be held financially responsible
if they serve alcohol to visibly intoxicated patrons who go on to
commit harm or damage while under the influence of alcohol.
