Government prosecutors are appealing the recent acquittal of
James Tobin in the 2002 Election-Day phone-jamming case.
Tobin, a former regional director for the Republican National
Committee, has been in court for years over his involvement in the
2002 effort to tie up Democratic get-out-the vote phone lines. In
2005, a federal jury convicted Tobin, of Bangor, Maine, of telephone
harassment in the case. Last year, a the First Circuit Court of
Appeals reversed that conviction, saying the harassment statute
didn't "fit" the crime, and sent the case back to Concord for more
arguments. Last month, a federal judge acquitted Tobin.
