US judge rules against Bush administration over "enemy combatant"

WASHINGTON, Feb. 28 (Xinhua) -- A federal judge in the United States ruled Monday that the Bush administration has no authority to detain a so-called "enemy combatant" indefinitely without charge.

US District Judge Henry Floyd said terrorism suspect Jose Padilla, who has been held in a South Carolina Navy prison for nearly three years, should either be charged or released within 45 days.

"The court finds that the president has no power, neither expressed nor implied, neither constitutional nor statutory, to hold petitioner as an enemy combatant," Floyd wrote in his ruling.
