Article: State trooper files civil suit for firing

A former state trooper who contends he was forced to retire for refusing to go along with an alleged cover-up in the fatal 2002 shooting of Michael Ellerbe has filed a civil suit in Fayette County claiming wrongful discharge.

In the filing, retired Sgt. James Baranowski named state police Lt. Charles Depp and Capt. Roger Waters as defendants.

Baranowski was the incident commander after the Christmas Eve shooting of Michael Ellerbe, 12, of Uniontown.

In the civil suit, he indicates that two months after the shooting, he informed superiors the incident did not occur as reported by the troopers who were involved.
