Article: Missouri Supreme Court rules class decertified in quarry blast suit

Homeowners who live near the Fred Weber quarry in O'Fallon, Mo., do not qualify as a class in a lawsuit against the quarry, the Missouri Supreme Court ruled Tuesday.

In a unanimous ruling, the Missouri Supreme Court reversed and remanded a decision by the St. Louis City Circuit Court that allowed for neighboring homeowners to proceed with a class action lawsuit against Fred Weber.

In October 1999, Peggy Green, who lived one-third of a mile from the quarry at the time, first began noticing the blasting activity. According to Green, the blasts ranged between five and 10 per week, and she spoke to homeowners as far as two miles from the quarry who felt the blasts.
