Family outraged after charges are dropped in beating death

DAYTON -- James J. Weddington's family is outraged that authorities have dropped the murder charge against a man who allegedly beat him to death.

Walter D. Delph, 50, was released from the Montgomery County Jail after investigators were unable to determine if he meant to kill Weddington or if he acted in self-defense, said Greg Flannagan, spokesman for the Montgomery County Prosecutor's Office.

"I just don't understand how this could happen," said Weddington's mother, Emma Lou Weddington. "How do you kill somebody and get away with it? It doesn't make sense."

Delph could face other charges from the incident, but none have been filed, Flannagan said.
