City Shouldn't Roll Out DWI Tow Trucks Yet

It may have sounded good back in 2005: Pass one of the toughest anti-DWI laws in the nation. Allow police to seize vehicles from suspected first-time drunken drivers. That will send a message. Unfortunately, it sends the wrong one.

Because the Albuquerque city ordinance, drafted at the request of Mayor Martin Chvez three years ago and given a temporary green light by the state Supreme Court last week, targets people who are suspected of DWI, not convicted.

That means anyone pulled over and arrested for his or her first DWI -- folks who very well may have been driving under the influence, as well as folks who may have been driving erratically, committed a minor traffic infraction or pulled ...
