Two Minnesota residents challenging the contract awarded for the
Interstate 35W bridge in Minneapolis want the state to stop the
reconstruction project.
If the judge in the case agrees, the Minnesota Department of
Transportation could wait out the trial or terminate the project
contract and re-bid the remaining portion of the work, said Dean
Thomson, the plaintiff's attorney with Fabyanske, Westra, Hart &
Thomson PA, Minneapolis. If that puts MnDOT in a bad position, then
it shouldn't have violated state rules when awarding the job, he
said.
"It's a tough spot of their own making, in the plaintiffs'
perspective," Thomson said. "They shouldn't have proceeded in the
first place."
