AN ASYLUM seeker was unable to show that a local authority had
failed, in her case, properly to implement its policy in relation to
the provision of subsistence.
The Court of Appeal dismissed the appeal of Maria Gjinji against
the dismissal of her application for judicial review of the decision
of Islington London Borough Council to reduce subsistence payments
made to her.
The claimant was an Albanian from Kosovo. She and her son had
sought asylum immediately on their arrival in the United Kingdom. The
claimant was immediately provided with accommodation and subsistence.

receiving child benefit in addition to the subsistence ...
