Article: Foundation Coal hit with pollution fine

Foundation Coal Holdings will pay more than $76,000 in fines for water pollution violations under the latest settlement proposed by the state Department of Environmental Protection.

The deal cites 39 violations of water pollution limits from nine permits operated by three Foundation subsidiaries in Mingo, Raleigh and Wyoming counties.

Foundation is the fourth corporate parent from the coal industry to reach a deal with the DEP in recent months to resolve Clean Water Act permit discharge limit violations.

Previously, the DEP worked out deals with Alpha Natural Resources, International Coal Group and CONSOL Energy Inc. In all, the four deals involved more than $1.6 million in civil penalties, ...
