Top court to hear challenge to cap

The Court of Appeals has agreed to hear a challenge to Maryland's statutory cap on non-economic damages in a lead-paint case. Lawyers for Kelly Green, 13, say the cap should not apply to cases that, like hers, were filed under the state Consumer Protection Act. Green, who suffered from lead poisoning as an infant and toddler, now has an above-average IQ and gets good grades in school. Green and her mother, represented by Brian S. Brown and the law firm of Saul E. Kerpelman & Associates in Baltimore, won non-economic damages of $2.3 million. The verdict was capped at $515,000.
