Appealed from County Court, Franklin County
Background: The defendant appeals from a judgment convicting him,
upon his guilty plea, of attempted assault in the second degree. The
defendant agreed to plead guilty to attempted assault in the second
degree in satisfaction of a four-count indictment. During the plea
colloquy, the defendant denied striking the victim, but admitted
that he wished to plead guilty to the crime in order to minimize his
prison exposure. The county court accepted the defendant's guilty
plea after further questioning him. The court ultimately elicited
