Article: Appellate court rules in favor of truckers in Clean Trucks Program suit

LOS ANGELES -- An appellate panel ruled today that a federal judge was wrong to deny a temporary injunction against some of the Clean Trucks Program's big-rig concession requirements at the Los Angeles and Long Beach ports.

The 9th Circuit Court of Appeals ruling is seen as a major victory for the American Trucking Associations, the trade organization that filed the original lawsuit.

Last summer, a Los Angeles federal judge rejected the ATA's request for a preliminary injunction that would halt part of the harbor clean trucks plan, which the association argued could jeopardize the ability of independent haulers to work at the ports.
