AFTER nearly two years of hanging in limbo, the 4th Circuit Court of Appeals last month lifted a federal injunction on permits from the Army Corps of Engineers for mountaintop removal mining.

The Obama administration's Environmental Protection Agency immediately called for a regulatory review of those previously blocked permits.

While any new administration certainly would want to be sure of its footing, long-established industries do not turn on a dime. Before investing millions into equipment and site preparation, mining companies must be sure they will be allowed to mine the coal.
