OT basis of suit vs. cable company

BOSTON - A Boston law firm has filed a complaint seeking class action status on behalf of a former contractor for RCN who claims the cable TV company should have paid him overtime for working beyond 40 hours a week.

The lawsuit, which was filed by Lichten & Liss-Riordan in Boston federal court on Monday on behalf of Fritz Elienberg of Roxbury, claims Elienberg and other cable TV installers were unfairly classified by RCN as "independent contractors."
