A Maryland appeals court has set aside an award of $15 million to
nine CSX Transportation Inc. employees, saying the jury should have
been allowed to consider whether factors such as age, obesity and
heredity contributed to their damages from work-related injuries.
Last week's ruling was just the first part of a "double whammy"
at the Court of Special Appeals for railroad-worker attorney P.
Matthew Darby.
In a separate decision the following day, the court affirmed a
defense verdict in the case of an electrocuted Amtrak worker.
Despite the losses, Darby remained optimistic, at least about a
new trial on damages in the CSX case.
