A win for Martek

Martek Biosciences Corp., of Columbia, won an appeals court ruling that the Nutrinova unit of Switzerland-based Lonza Group AG infringed two of its patents. The U.S. Court of Appeals for the Federal Circuit in Washington affirmed most of a lower court's ruling, while also finding Martek could press claims over a third patent. A lower court in Wilmington, Del., initially found that patent to be invalid. The lower court prohibited Lonza, the world's largest maker of drug ingredients, from marketing DHA docosahexaenoic acid products that infringe two Martek patents. Martek makes products from microalgae, including nutritional oils used in infant formula.
