Article: Dispute in Hiring of Administrative Law Judges May Not Be Over

The press release carried a celebratory headline: "Court of
Appeals Upholds Scoring System Established by the U.S. Office of
Personnel Management Protecting Veterans' Preference."
A three-judge panel of the U.S. Court of Appeals for the Federal
Circuit had ruled in favor of OPM in a long-running dispute over a
formula used in hiring administrative law judges. OPM had changed the
formula in 1996 and effectively tilted the playing field in favor of
military veterans who applied for the plum positions.
But OPM's victory declaration on March 3 may have been premature.
