Beer containing 3.2 percent alcohol would be viewed in the
same class as alcoholic beverages if voters approved a resolution
introduced Monday by state Sen. Helen Cole, R-Moore.
"My purpose is not to do away with beer, but to have some
regulation for it, and you can't do that as long as that section
is in the Constitution," she said.
The Oklahoma Constitution excludes "beer or cereal malt
beverages containing not more than 3.2 percent of alcohol by
weight" from regulation by the Oklahoma Alcoholic Beverage
Control Board and Alcohol Beverage Law Enforcement (ABLE)
Commission.
