Wauwatosa The Wauwatosa firefighter who flipped his car on his way to work this month was driving with a blood-alcohol level of 0.278, more than three times the legal limit, police said Tuesday.

Lt. David C. Sperry, a 25-year veteran of the department, will resign effective April 19, and in return will receive no disciplinary action, Fire Chief Dean Redman said. With accrued time off, Sperry will be on leave until his resignation.

Sperry, 49, of Brookfield, faces two municipal counts of driving while intoxicated and driving with a blood-alcohol level above the legal limit of .08 after flipping his car on the Menomonee River Parkway about 8 a.m. Jan. 10.
