Article: Armed robbery conviction thrown out Court says lesser offense should have been option

An appeals court panel on Wednesday reversed a Milwaukee man's armed robbery conviction, saying that a Waukesha County circuit judge had erred by not allowing the jury to consider a lesser offense.

Judge Lee S. Dreyfus Jr. should have allowed jurors to consider theft as a lesser-included charge of armed robbery when deciding the case of Keith Jones, an appeals court panel in Waukesha ruled.

Jones and Vernon Patterson, also of Milwaukee, were each charged with party to the crime of armed robbery for the theft of jeans from a Kohl's Department Store in Delafield on Dec. 21, 1996.
