Blood test for driver in crash is upheld

Madison -- Requiring a man to take a blood test after being arrested on suspicion of drunken driving did not violate his constitutional rights, a state appeals court panel ruled Thursday.

The ruling by the 4th District Court of Appeals panel was the second in as many weeks upholding Wisconsin's implied consent law.

The law requires drivers stopped on suspicion of drunken driving to submit to a blood or breath test or lose their driver's licenses.

The state had appealed a ruling of Richland County Circuit Judge Edward Leineweber, who suppressed John Thorstad's blood test as evidence.
