WASHINGTON - The Supreme Court agreed yesterday to rule on the
legality of the Maine RX Program, a case that presents a significant
test of states' power to drive down prescription drug prices.
The justices, hinting that they have set a priority on settling
key questions of state authority to control the escalating cost of
medicines, brushed aside a suggestion by the Bush administration that
it was premature for the court to get involved.
The fate of Maine's program is of wide interest, with 27 other
states considering adopting a similar approach to cutting drug costs,
especially for elderly and low-income patients. A number of states
