Gary Lee Sampson will face the death penalty on federal murder
charges, a judge decided yesterday when he denied Sampson's attempt
to make an end run around prosecutors and cut a deal that would spare
his life.
Sampson is charged with murdering three men during a weeklong
spree in July 2001. His defense team had asked US District Judge Mark
L. Wolf to declare the Federal Death Penalty Act unconstitutional and
allow Sampson to plead guilty and serve a life sentence without
parole.
Yesterday morning, after an hour of legal arguments, Wolf denied
the request and scheduled a Sept. 15 trial date for Sampson.
