Next month's special election to oust Nashua Mayor Bernie Streeter is off at least for now.

Hillsborough County Superior Court Judge Gary Hicks last week agreed with Streeter that holding a recall election would violate state law. The state, he wrote in his opinion, authorizes municipalities to remove a mayor from office only for cause, such as prolonged absence, inattention to duties, crime, or misconduct in office, and it can occur only after a notice and hearing by the Board of Aldermen.

Hicks said the 14-year-old state law governing a mayor's removal nullifies the recall provision in Nashua's charter, which was approved by the Legislature in 1913. The city had argued that the state law ...
