Last month, when the state Supreme Judicial Court ruled that
the town of Burlington acted in bad faith when it took land by
eminent domain to prevent the construction of low- and
moderate-income rental housing, the age-old practice of government
taking private land for a public good got a brisk slap on the wrist.
Despite Burlington's claims that it took the land to make room
for "parks, recreation and the construction of moderate-income
housing," the court ruled otherwise, that the town took the land to
block the development of 202 apartments, 20 percent of which were
to be set aside for low- and moderate- income tenants.
