Article: SJC RULES IN FAVOR OF 2D CHANCE TO INDICT SAME CASE CAN GO TO ANOTHER GRAND JURY

The state's highest court ruled yesterday that prosecutors seeking criminal indictments can present the same evidence to a second grand jury if they're not happy with the vote of the first.

The Supreme Judicial Court reserved judgment, however, on whether a prosecutor could present identical evidence more than twice.

"What the court has done is make clear to prosecutors that if they don't get the result they want the first time, they can go back to some other grand jury they might have more luck with," said Boston defense attorney Kathy Weinman.
