PLYMOUTH - A clerk magistrate has refused to issue criminal charges against Police Chief Robert Pomeroy and Town Manager Eleanor Beth for telling a police officer he would be fired if he did not submit to a lie detector test.

Falmouth District Court Magistrate Kenneth Halloran yesterday denied police officer Kevin Furtado's application for criminal charges against the pair, citing insufficient evidence.

"I'm very pleased and relieved," Beth said. "You make these decisions, based on advice from counsel, thinking you're doing the correct thing and acting in the town's best interest, but until a court says so you're never really sure. I'm relieved it's over." Leonard ...
